법경제학은 최근 발전하고 있는 경제학의 한 분야이다. 개인의 선택과 결정의 문제는 법과 제도의 영향을 받을 수밖에 없다. 자신의 이익을 극대화하기 위해 노력하는 개인과 기업의 행동은 법과 제도가 제공하는 이른바 유인(incentive)에 영향을 받는다. 따라서 법과 제도는 경제적 성과에 직접적인 영향을 미친다. 법경제학은 법이라는 현상에 대하여 효율 극대화의 관점에서 경제학을 통해 설명하려는 학문이다. 구체적으로는 법이 경제에 미치는 효과를 비교하여 어떤 법이 바람직한지 등을 주로 분석한다. 본 강의는 경제학을 독점금지법과 기타의 경제규제에서 나아가 불법행위법, 계약법, 재산법, 형법 등에 적용해보고 경제학을 통해 법과 제도를 이해하는데 도움을 주도록 한다.

Law and economics is an area of economics that has developed recently. The issue of individual choices and decisions must be affected by laws and institutions. The behavior of individuals and firms trying to maximize their own interests is affected by the so-called incentives provided by laws and institutions. Thus, laws and institutions have a direct impact on economic performance. Law and economics is a study that attempts to explain the phenomenon of law through economics from the perspective of maximizing efficiency. Specifically, it mainly analyzes which laws are desirable by comparing the effects of laws on the economy. This lecture applies economics to antitrust laws and other economic regulations, and tort laws, contract laws, property laws, criminal laws, etc, as well, and helps understand laws and institutions through economics.
